An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

Fuller Living and Associates, LLC may periodically send promotional materials or notifications related to the Fuller Living and Associates, LLC Services. If you want to stop receiving promotional materials, you can respond STOP to a text message or follow the unsubscribe instructions at the bottom of each email. There are certain service notifications or other non-promotional emails that you may not opt out of, such as notifications of changes to the Fuller Living and Associates, LLC Services or policies. If you have installed a mobile app and you wish to stop receiving push notifications, you can change the settings either on your mobile device or through the app.

To share with our Company Affiliates, Fuller Living and Associates, LLC may share your information with Fuller Living and Associates, LLC Affiliates for the purposes described in this Privacy Policy. To protect the rights of Fuller Living and Associates, LLC, and others

Location of Data

The Fuller Living and Associates, LLC Services are hosted in and managed from the United States. If you are a user located outside the United States, you understand and consent to having any personal information (which may include information collected through the use of cookies and other technologies, as described above) processed in the United States or in any other country in which we have facilities or in which we engage service providers. The United States and other countries’ data protection laws may not be the same as those in your jurisdiction. The Fuller Living and Associates, LLC Services may be linked to sites operated by unaffiliated companies and may carry advertisements or offer content, functionality, newsletters, or applications developed and maintained by unaffiliated companies. Fuller Living and Associates, LLC is not responsible for the privacy practices of unaffiliated companies, and once you leave the Fuller Living and Associates, LLC Services or click an advertisement, you should check the applicable privacy policy of the other service.

In addition, Fuller Living and Associates, LLC is not responsible for the privacy or data security practices of other organizations, such as Facebook, Tumblr, Twitter, Apple, Google, Microsoft or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including in connection with any information you disclose to other organizations through or in connection with the Fuller Living and Associates, LLC Services.

Collection of Personal Financial Information by a Payment Service. In some cases, we may use an unaffiliated payment service to allow you to purchase a product or make payments (“Payment Service”). If you wish to purchase a product or make a payment using a Payment Service, you will be directed to a Payment Service webpage. Any information that you provide to a Payment Service will be subject to the applicable Payment Service’s privacy policy, rather than this Privacy Policy. We have no control over and are not responsible for any Payment Service’s use of information collected through any Payment Service.

Data Retention

We will retain your information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or allowed by law.

Remember that even if you ask us to delete your personal information, copies of some information from your account may remain viewable in some circumstances where, for example, you have shared information with social media or other services. Because of the nature of caching technology, your account may not be instantly inaccessible to others. We may also retain backup information related to your account on our servers for some time after cancellation or your deletion request, for fraud detection or to comply with applicable law or our internal security or recordkeeping policies. It may not always be possible to completely remove or delete all of your information due to technical constraints, or contractual, financial, or legal requirements.
Sensitive Information. We ask that you not send us, and you do not disclose, any sensitive personal information (such as social security numbers, information related to racial or ethnic origin, religion or other beliefs, health, criminal background, or trade union membership) on or through the Fuller Living and Associates, LLC Services or otherwise. Your use of the Fuller Living and Associates, LLC Services is at your own risk. Fuller Living and Associates, LLC urges you to take steps to keep your information safe by memorizing your password or keeping it in a safe place (separate from your account information), logging out of your account, and closing your web browser. In order to help us protect your information further, you should be careful about providing your password to others.

Whenever you give Fuller Living and Associates, LLC sensitive or confidential information, Fuller Living and Associates, LLC will take commercially reasonable steps to protect the information by establishing a secure connection with your web browser. Fuller Living and Associates, LLC uses an industry-standard security protocol for encrypting sensitive information. Unfortunately, no security measures are perfect or impenetrable, and data transmission over the Internet cannot be guaranteed 100% secure. We cannot and do not ensure or warrant the security of any information you transmit to Fuller Living and Associates, LLC, and you do so at your own risk.

 

NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Fuller Living Counseling & Associates (“FLC”) is required by federal and Minnesota law to protect the privacy of your Protected Health Information (PHI). This Notice explains how we may use and disclose your information and describes your rights.

OUR LEGAL DUTIES

FLC is required by:

• The Health Insurance Portability and Accountability Act (HIPAA)
• The Health Information Technology for Economic and Clinical Health (HITECH) Act
• Minnesota Health Records Act (Minn. Stat. §§144.291–144.298)
• Minnesota Statute §245I.10 (Mental Health Licensing Standards)

We must:

1. Maintain the privacy of your PHI
2. Provide you with this Notice
3. Follow the terms currently in effect
4. Notify you if a breach of unsecured PHI occurs

HOW WE MAY USE AND DISCLOSE YOUR INFORMATION

1. Treatment

We may use and disclose your PHI to provide, coordinate, and manage your care.

Examples:

• Consultation with other providers
• Clinical supervision (as required under Minn. Stat. §245I.10)
• Referral to psychiatrists or specialists

The same confidentiality laws bind supervisors to review records as those that bind treating clinicians.

2. Payment

We may use and disclose PHI to obtain payment for services.

Examples:

• Submitting insurance claims
• Verifying eligibility
• Collecting balances

If you pay out of pocket in full, you may request that we not disclose the service to your health plan. We will comply with the law as required.

3. Health Care Operations

We may use PHI for operational purposes, including:

• Quality improvement
• Staff training
• Licensing compliance
• Audits
• Business associate activities

All business associates are contractually required to protect your PHI.

4. Disclosures Required or Permitted by Law

We may disclose PHI without your consent when required or permitted by law, including:

• Court orders signed by a judge
• Child abuse or neglect reporting (Minn. Stat. §626.556)
• Vulnerable adult abuse reporting (Minn. Stat. §626.557)
• Serious and imminent threat to health or safety
• Public health reporting
• Health oversight activities
• Workers’ compensation claims
• Law enforcement purposes consistent with the law

When possible and appropriate, we will inform you of such disclosures.

5. Disclosures to the U.S. Department of Health and Human Services

We are required to disclose PHI to the Secretary of Health and Human Services if requested for compliance investigations or enforcement.

6. Uses and Disclosures Requiring Written Authorization

We will obtain your written authorization for:

• Disclosures not otherwise permitted by law
• Release of psychotherapy notes (except limited HIPAA exceptions)
• Marketing communications requiring authorization
• Any sale of PHI (FLC does not sell PHI)

You may revoke authorization at any time in writing, except where action has already been taken.

MINNESOTA-SPECIFIC CONSENT REQUIREMENTS

(Minn. Stat. §144.293)

Minnesota law is often more restrictive than HIPAA.

Except as permitted or required by law, we must obtain your written informed consent before releasing your health records.

Your written consent must include:

• The specific information to be disclosed
• The name of the recipient
• The purpose of disclosure
• An expiration date or event
• Your signature and date

You may revoke consent in writing at any time.

 

YOUR RIGHTS UNDER HIPAA AND MINNESOTA LAW

Right to Access (Minn. Stat. §144.292)

You have the right to inspect and obtain a copy of your health records.

• Requests must be in writing.
• We will respond as promptly as possible and no later than 30 calendar days after receiving your written request.
• Reasonable cost-based fees may apply.
• If access is denied, you will receive a written explanation of appeal rights.

If records are maintained electronically and requested electronically, we will provide them electronically when feasible.

Right to Request Amendment

You may request correction of inaccurate or incomplete information.

If we deny the request, you will receive a written explanation.

Right to an Accounting of Disclosures

You may request a list of certain disclosures made within the past six years, excluding:

• Treatment, payment, and operations
• Disclosures made with your authorization

Right to Request Restrictions

You may request restrictions on certain uses or disclosures. We are not required to agree except where federal law mandates.

Right to Confidential Communications

You may request communication at alternative locations or through specific methods.

Right to a Paper Copy

You may obtain a paper copy of this Notice at any time.

 

MINORS AND CONFIDENTIALITY

Under Minnesota law, minors may consent to certain services.

When a minor legally consents:

• The minor’s records may not be disclosed to parents without the minor’s consent, unless required by law.
• We may withhold information from a parent if disclosure would be harmful to the minor.

Parental rights are determined by Minnesota law and case-specific circumstances.

SPECIAL PROTECTIONS

Certain records receive additional protections under federal and state law, including:

• Substance Use Disorder treatment records (when applicable under 42 CFR Part 2)
• HIV-related information
• Psychotherapy notes

BREACH NOTIFICATION

If unsecured PHI is breached, we will notify you without unreasonable delay and no later than 60 days after discovery.

OUR RIGHT TO CHANGE THIS NOTICE

We reserve the right to revise this Notice. Updated versions will:

• Apply to all PHI we maintain
• Be posted in our office
• Be available upon request
• Be posted on our website, if applicable
